Terms of Service
Welcome to AbyssDev! Thank you for choosing our team. Before requesting any services or products from us, please read the following terms and conditions listed below completely and carefully.
Please note that throughout this document, “we,” “us,” and “our” refer to the management of AbyssDev, and “you” refers to the client.
General Terms
- AbyssDev is not affiliated with any third party to which we would sell or distribute your information.
- If AbyssDev becomes affiliated with a third party, we will never sell or distribute any of your information.
- Any information you share within our Discord server will be available to anybody who has access to the channel in which you shared it.
- AbyssDev will keep an archive of any and all commission and support tickets, to be used as evidence in the event of a scam report, payment dispute, chargeback, or similar occurrence. These archives will remain private unless they are to be used as evidence in the above situations, or unless it is required of us by law to release them.
Products & Services
- We reserve the right to change the products and services we offer at any time without warning or notification.
- We reserve the right to terminate service at any time if the client’s request is found to be in breach of these terms, in violation of any relevant platform’s terms (such as, but not limited to, Discord or Mojang), or in any way illegal.
- We reserve the right to terminate service at any time if the client violates AbyssDev’s rules or TOS, including harassment of AbyssDev freelancers or staff.
- Once a product is sold, it is no longer our responsibility. We are not liable for any loss of files, code, or other content that occurs after the completed product is received.
- Clients will receive the source code to all products commissioned from our team, but they do not have permissions to resell, rebrand, or claim any products that they receive.
- AbyssDev maintains a 72-hour “revisionary period” during which freelancers are required to complete any minor changes, bug fixes, or other revisions to a product.
- This does not cover major changes or content additions, and all freelancers have a right to have these requests evaluated fairly by their commission manager.
- After this period has elapsed, freelancers may provide continued support for a product at their own discretion. The revisionary period and continued support should both be negotiated with the freelancer prior to payment completion.
Payments
- If you are commissioning live work, such as on-server building, configuration, system administration, or any other service deemed by a freelancer or manager to be “live work,” you must complete payment 100% up-front.
- If you are commissioning non-live work, you may pay either 50% up-front and 50% after the completion of the work (but before the final files are sent), or 100% up-front. You will not receive any final, un-watermarked, or un-branded products until after 100% of payment has been made.
Freelancer Rights and Extra Charges
- Unless otherwise specified by the client, freelancers have the right to use any work that they do in their personal portfolios.
- Freelancers have the right to request additional charges for changes made to a commission after a quote was given. If you don’t believe these extra charges are warranted, your commission manager can determine this objectively.
- Clients do not have the right to rebrand, resell, remarket, redistribute, or otherwise claim as their own any work done by a AbyssDev freelancer.
- AbyssDev has the right to use any work created by our freelancers on our team portfolio unless the client specifically and explicitly requests otherwise.
Premade Products
- Clients do not have resale or redistribution rights to any product, premade or otherwise, purchased from us.
- The purchase of premade products does not include access to the source code of that product. Clients may purchase source code access at an additional cost, but they may not deobfuscate or otherwise unrightfully access the code of a premade product.
- Clients are responsible for the actions of anyone who accesses premade products through them. If someone else with access to the client’s download leaks the product, the purchaser is responsible.
Privacy Policy
AbyssDev is committed to ensuring all of our clients’ data and information is safe.
- AbyssDev is not affiliated with any third party to which we would sell or distribute your information.
- If AbyssDev becomes affiliated with a third party, we will never sell or distribute any of your information.
- Any information you share within our Discord server will be available to anybody who has access to the channel in which you shared it.
- AbyssDev will keep an archive of any and all commission and support tickets, to be used as evidence in the event of a scam report, payment dispute, chargeback, or similar occurrence. These archives will remain private unless they are to be used as evidence in the above situations, or unless it is required of us by law to release them.
Refund Policy
AbyssDev will only issue refunds in very specific circumstances, all at the discretion of management. They include:
Substandard Work: If a freelancer’s work is deemed to be below AbyssDev’ standards of work, their client will be entitled to a maximum refund of 75%.
Client Dissatisfaction: If the client is unsatisfied with a freelancer’s work, but the work is otherwise up to our standards, they may be issued a refund of up to 50% (only in the circumstance that the reason for the client’s dissatisfaction is deemed truthful by our management team). However, this refund will be a last resort, as clients will be asked to either pay for extra features (as per our extra charges policy); find another freelancer to complete the work for the already-paid price; or free or paid revisions by the same or a different freelancer.
Missed Deadline: If the freelancer misses the agreed-upon deadline, your commission manager will work with you to either issue a partial refund, or to find another freelancer to complete the project.
Tebex Limited
We partner with Tebex Limited (www.tebex.io), who are the official merchant of digital content produced by us. If you wish to purchase licenses to use digital content we produce, you must do so through Tebex as our licensed reseller and merchant of record. In order to make any such purchase from Tebex, you must agree to their terms, available at https://checkout.tebex.io/terms. If you have any queries about a purchase made through Tebex, including but not limited to refund requests, technical issues or billing enquiries, you should contact Tebex support at https://www.tebex.io/contact/checkout in the first instance.
